Legal counsel in relation to a nationwide debt recovery plan initiated by a major leasing company acting on the Romanian market against more than 800 default clients. While relevant strategies approached in each individual case range from assistance in foreclosures proceedings, to initiating summary and common legal actions, or representation in insolvency procedures and bankruptcy legal files, the firm seconded a full time team at the client to act as a liaison in managing the files.
Retained by a leading Romanian pharmaceuticals distributor as legal counsel in the complex debt recovery program initiated by the said against its default clients. Rendered services focused on identifying settlement opportunities and ensuring the benefit of the debts in case of threatened bankruptcy of the debtors, customized enforcement of the debtors aimed to ensure the efficiency of the recovery, involvement in the appointment of and negotiations regarding the powers of the special administrators/liquidators, assessing legal feasibility of reorganization plans, including providing restructuring strategies, ensuring the debt collection after the liquidation of assets of the debtors.
Representation of a world leading tire and rubber company in the voluntary insolvency procedure initiated by one of its debtors for reorganization purposes. Aimed at the recovery of a debt amounting to approximately EUR 1.5 million, this instruction covered registration with the statement of affairs in the procedure, representation in the meetings of the creditors, as well as court representation.
Successfully represented an international hotel chain operator in the insolvency procedure initiated by one of its debtors against the client for an alleged debt, with the firm’s lawyers obtaining the full rejection by the court of justice of the said claim.
Representation of a retail self storage facility operator active on the regional market acting as debtor in the insolvency procedure initiated against it by a contractual partner operating on the constructions market for the recovery of an alleged debt in the range of a few hundred of thousands EUR. The firm assisted the client in the recourse filed against the procedure, in obtaining a stay order in the insolvency court action, as well as on all other legal issues pertaining to this case.
